DMCA Copyright Policy

AshemaleParadise respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. This page explains how to submit a valid takedown notice, how to file a counter-notification, our designated agent, and our repeat infringer policy. The same information is provided in English and Spanish below.

1. What the DMCA is and who it applies to

The Digital Millennium Copyright Act (DMCA) is a United States law (17 U.S.C. §§ 512, 1201 et seq.) that provides a notice-and-takedown process for online service providers. AshemaleParadise operates as a service provider / aggregator that indexes, links to, and embeds third-party content. We do not produce the video content displayed on this site. When we receive a compliant notice we act expeditiously to remove o disable access to the allegedly infringing material.

This policy applies to any copyright owner (or authorized agent) who believes that content accessible on ashemaleparadise.com infringes their exclusive rights, and to any user whose content was removed and who wishes to file a counter-notification. Offshore hosting does not change this process — we respond to valid notices regardless de where the storage bucket o CDN edge is located, including Cloudflare (US), Volverblaze B2 (US), the domain registrar, and payment processors.

2. What a valid DMCA notification must include — 6 elements under 17 U.S.C. § 512(c)(3)

To be valid, a notification must be in writing and include all six de the following elements required by § 512(c)(3)(A)(i)–(vi). Incomplete notices may be rejected o require additional information, which will delay processing.

1. (i) Signature — A physical o electronic signature de a person authorized to act on behalf de the owner de an exclusive right that is allegedly infringed.
2. (ii) Infringed work — Identification de the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notification, a representative list de such works (e.g., title, URL de the original work, registration number if available).
3. (iii) Infringing material — exact URL on ashemaleparadise.com — Identification de the material that is claimed to be infringing and information reasonably sufficient to permit us to locate it. You must provide the exact URL(s) on ashemaleparadise.com (e.g., https://ashemaleparadise.com/videos/12345/title o the shorts/watch page). A general description de the site, a search term, o a homepage link is not sufficient.
4. (iv) Contacto information — Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and an email address. Anonymous notices cannot be processed.
5. (v) Irod-faith statement — A statement that you have a good-faith belief that use de the material in the manner complained de is not authorized by the copyright owner, its agent, o the law.
6. (vi) Accuracy and perjury statement — A statement that the information in the notification is accurate, and under penalty de perjury, that you are authorized to act on behalf de the owner de an exclusive right that is allegedly infringed.

3. Designated Agent

DMCA notices and counter-notifications should be directed to our Designated Agent. We have not currently appointed a separate registered agent with the U.S. Copyright Office; the contact below functions as the Designated Agent for all purposes under § 512(c)(2) and we respond on the same <24-hour SLA as a registered agent would.

Only notices concerning copyright infringement should be sent to this address. Other inquiries (support, model claims, general contact) should use ashemaleparadise.com/about/.

4. How to submit a takedown notice — form + email

You may submit a notice in two ways. The fastest is the form below (stored in our compliance queue and emailed to the agent); you may also email the same information directly to [email protected].

5. Counter-notification — 17 U.S.C. § 512(g)

If you believe content was removed o disabled as a result de mistake o misidentification, you may submit a counter-notification under § 512(g)(3). A valid counter-notification must include:

1. Your physical o electronic signature.
2. Identification de the material that was removed o disabled and the location where it appeared before removal (exact URL on ashemaleparadise.com).
3. A statement under penalty de perjury that you have a good-faith belief that the removal o disabling was a result de mistake o misidentification.
4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction de the Federal District Court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which AshemaleParadise may be found), and that you will accept service de process from the person who provided the original notification o their agent.

Send counter-notifications to the same Designated Agent: [email protected] with subject "DMCA Counter-Notification". Upon receipt de a valid counter-notification, we will forward it to the original complainant. The removed material may be restored in 10–14 business days unless the original complainant notifies us that they have filed an action seeking a court order to restrain the alleged infringer (§ 512(g)(2)(C)). Filing a false counter-notification may expose you to liability under § 512(f).

6. Repeat Infringer Policy — 3 strikes

AshemaleParadise maintains a repeat infringer policy as required by § 512(i)(1)(A). In appropriate circumstances we terminate and/or ban users who are repeat infringers.

• 3 strikes → ban + deletion: A user/account that accumulates three (3) valid copyright strikes (i.e., three separate notices that resulted in removal/actioned) will have their account terminated, their upload privileges revoked, and infringing content deleted. Depending on severity, fewer strikes may suffice.
• Strikes are tracked per account and per uploader. Evading a ban by creating new accounts is prohibited and will result in immediate termination de all associated accounts.
• When content is removed pursuant to a valid notice, we delete the file and all associated copies.
• We also maintain an internal record de removed content so that re-uploads de the same file are rejected automatically.
• We may also remove o disable access to content at our discretion for other policy violations, even without a formal DMCA notice.

Transparency & Lumen Database

For transparency, we may submit a copy de valid, actioned notices (with personal contact details redacted) to the Lumen Database (lumendatabase.org), a public archive that collects takedown requests for research and transparency. Submitting to Lumen is optional and done manually after review — it does not affect the processing time de your notice. If you prefer that a notice not be forwarded to Lumen, state so explicitly in your submission.

SLA

We strive to acknowledge every compliant notice within 24 hours (business hours) and to remove o disable access to verified infringing material within 48 hours. Timestamps (created_at → actioned_at) are tracked internally for SLA measurement.

AshemaleParadise respeta los derechos de propiedad intelectual y cumple con la Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. A continuación se explica en español cómo presentar una notificación válida, cómo presentar una contranotificación, quién es el agente designado y nuestra política de infractores reincidentes.

1. Qué es la DMCA y a quién aplica

La DMCA es una ley de Estados Unidos (17 U.S.C. §§ 512, 1201 et seq.) que establece un proceso de notificación y retirada para proveedores de servicios en línea. AshemaleParadise opera como proveedor/agregador que indexa, enlaza y embebe contenido de terceros. No producimos el contenido de vídeo mostrado en el sitio. Cuando recibimos una notificación válida, actuamos con diligencia para retirar o deshabilitar el acceso al material presuntamente infractor.

Esta política aplica a cualquier titular de derechos (o su agente autorizado) que considere que contenido accesible en ashemaleparadise.com infringe sus derechos exclusivos, y a cualquier usuario cuyo contenido fue retirado y desee presentar una contranotificación. El alojamiento offshore no modifica este proceso — respondemos a notificaciones válidas independientemente de dónde esté el bucket de almacenamiento o el edge del CDN, incluyendo Cloudflare (EE. 2. Qué debe incluir una notificación válida — 6 elementos bajo 17 U.S.C. § 512(c)(3)

Debe proporcionar la(s) URL(s) exacta(s) en ashemaleparadise.com (p. ej., https://ashemaleparadise.com/videos/12345/titulo). Una descripción general, un término de búsqueda o un enlace a la portada no es suficiente.
4. (iv) Datos de contacto — Información razonablemente suficiente para contactarle: dirección, teléfono y correo electrónico. Las notificaciones anónimas no pueden tramitarse.

3. Agente Designado

Solo deben enviarse a esta dirección notificaciones relacionadas con infracción de derechos de autor. Otras consultas deben dirigirse a ashemaleparadise.com/about/.

4. Cómo enviar una notificación — formulario + email

Puede usar el formulario superior (en inglés) o enviar la misma información directamente a [email protected]. El formulario valida la URL con filter_var y guarda la solicitud en nuestra cola dmca_notices con estado new → actioned / rejected. También puede usar esta plantilla de email en español.

5. Contranotificación — 17 U.S.C. § 512(g)

Si considera que el contenido fue retirado por error o identificación incorrecta, puede presentar una contranotificación bajo § 512(g)(3) con: (1) su firma, (2) identificación del material retirado y su ubicación previa (URL exacta), (3) declaración bajo pena de perjurio de que cree de buena fe que la retirada fue por error, y (4) su nombre, dirección, teléfono, consentimiento a la jurisdicción del tribunal federal competente y aceptación de notificación del reclamante original. Envíela a [email protected] con asunto "DMCA Counter-Notification / Contranotificación DMCA". Tras recibirla, la reenviaremos al reclamante original y el material podrá restaurarse en 10–14 días hábiles salvo que el reclamante nos notifique que ha iniciado acción judicial (§ 512(g)(2)(C)). Presentar una contranotificación falsa puede generar responsabilidad bajo § 512(f).

6. Política de infractores reincidentes — 3 strikes

AshemaleParadise mantiene una política de infractores reincidentes conforme a § 512(i)(1)(A). En circunstancias apropiadas, terminamos y/o bloqueamos a usuarios reincidentes:

• 3 strikes → bloqueo + borrado: Una cuenta que acumule tres (3) strikes válidos (tres notificaciones separadas que resultaron en retirada / actioned) será terminada, se revocarán sus privilegios de subida y se borrará el contenido infractor. Según la gravedad, pueden bastar menos strikes.
• Los strikes se cuentan por cuenta y por uploader. Evadir un bloqueo creando cuentas nuevas está prohibido y conlleva terminación inmediata de todas las cuentas asociadas.
• Cuando se retira contenido tras una notificación válida, eliminamos el archivo y todas sus copias asociadas.
• Mantenemos también un registro interno del contenido retirado para rechazar automáticamente futuras resubidas del mismo archivo.
• Podemos retirar o deshabilitar contenido a nuestra discreción por otras violaciones, incluso sin notificación formal DMCA.

Transparencia y Lumen Database

Por transparencia, podemos enviar copia de las notificaciones válidas y ejecutadas (con datos personales redactados) a Lumen Database, archivo público que recopila solicitudes de retirada con fines de investigación y transparencia. El envío a Lumen es opcional y manual tras revisión — no afecta el plazo de tramitación. Si prefiere que no se reenvíe a Lumen, indíquelo expresamente en su solicitud.

SLA

Nos esforzamos por acusar recibo de toda notificación válida en menos de 24 h (horario laboral) y retirar o deshabilitar el material verificado en menos de 48 h. SLA: Respondemos en <24h hábiles, retiramos en <48h. Medición interna: created_at → actioned_at.
